These Terms of Service ("Terms") govern your use of the Operational Durability Check assessment tool ("Assessment") operated by Ascension Strategy Solutions LLC ("we," "us," or "our") at durabilityscore.com.

By using the Assessment, you agree to these Terms. If you do not agree, please do not use the Assessment.

1. Description of Service

The Operational Durability Check is a free self-assessment tool designed to help mission-driven organizations evaluate their operational resilience and security posture. The Assessment:

  • Collects information about your organization through a series of questions
  • Calculates a "Durability Score" based on your responses
  • Provides AI-generated analysis and recommendations
  • Suggests relevant services based on your results

2. User Responsibilities

By using the Assessment, you agree to:

  • Provide accurate and truthful information
  • Use the Assessment only for legitimate organizational evaluation purposes
  • Not attempt to manipulate, hack, or interfere with the Assessment
  • Not use automated systems or bots to access the Assessment
  • Not share your Assessment results in a way that misrepresents our services

3. Assessment Results Disclaimer

Important: The Durability Score and associated analysis are provided for informational and educational purposes only. They do not constitute:

  • Professional security advice
  • Legal advice
  • A security audit or penetration test
  • A guarantee of security or operational resilience
  • A certification or compliance assessment

The Assessment provides general guidance based on self-reported information. Your actual security and operational posture may differ from what the Assessment indicates. You should not rely solely on these results for critical security decisions.

4. AI-Generated Content

The personalized analysis in your results is generated by artificial intelligence (Anthropic's Claude). While we strive for accuracy:

  • AI-generated recommendations may not account for all aspects of your specific situation
  • The analysis is based only on the information you provide in the Assessment
  • AI outputs should be reviewed and validated before taking action
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content

5. No Guarantee of Security

We make no representations or warranties that:

  • Following our recommendations will prevent security incidents
  • Your organization will achieve any particular security outcome
  • The Assessment identifies all vulnerabilities or risks
  • Our services will prevent data breaches, attacks, or other security events

Security is a continuous process that depends on many factors beyond the scope of this Assessment.

6. Intellectual Property

The Assessment, including its methodology, scoring system, questions, and design, is the intellectual property of Ascension Strategy Solutions LLC. You may not:

  • Copy, reproduce, or distribute the Assessment methodology
  • Create derivative works based on the Assessment
  • Use our branding or trademarks without permission
  • Reverse engineer the scoring algorithms

Your Assessment results are yours to use and share as you see fit.

7. Privacy

Your use of the Assessment is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Assessment is provided "as is" without warranties of any kind
  • We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims arising from the Assessment shall not exceed $100

9. Indemnification

You agree to indemnify and hold harmless Ascension Strategy Solutions LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Assessment
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective when posted to this page. Your continued use of the Assessment after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the Assessment at any time, without notice, for any reason, including violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Fulton County, Georgia.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
